Introduction

Public Impact® is a North Carolina corporation with its principal business address at 405 East Main Street, Suite A, Carrboro, NC 27510-2394. Opportunity Culture® is an education initiative that is owned and operated by Public Impact® through which several services are provided, including websites at https://publicimpact.com/ and https://www.opportunityculture.org/ (“Websites”) and a portal accessible at https://www.opportunityculture.schoolexcellenceportal.org/ that is used to facilitate educators and educational institutions in gaining certification, certificates of completion, validation, and other indications of status at various levels for their professional skills and educational activities (“Opportunity Culture® Portal”).

This privacy policy (“Privacy Policy”) is associated with and integrated as part of our Terms of Use, our Opportunity Culture® Portal Terms of Use and all terms in this Privacy Policy have the meaning established in those Terms of Use.

Public Impact®/Opportunity Culture® (“Us” or “We”) respect your privacy and are committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you visit our Websites or Opportunity Culture® Portal and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect on our Websites and Opportunity Culture® Portal from and about visitors, and authorized Users, including individuals, organizations, entities and others affiliated with our subscribers.

This policy does not apply to information collected by any third party by any means, including through any application or content (including advertising) that may link to or be accessible from our Websites or the Opportunity Culture® Portal.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Websites or Opportunity Culture® Portal. By accessing or using our Websites or Opportunity Culture® Portal, you agree to this privacy policy. This privacy policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of our Websites or Opportunity Culture® Portal after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Types of Information Collected

Collection of Personal Information

We define “personal information” as any data or information that personally identifies a person or that, together with any other available data, makes any person identifiable  (“Personal Information”).

Some of the services provided by us do not require any Personal Information from you. However, in instances like subscribing to our publications or accessing the Opportunity Culture® Portal in order to apply for certification or validation and/or pursue certificates for completing courses provided via the Opportunity Culture® Portal, we may require Personal Information from you when accessing and/or using our services. Participating in these activities and providing your information is voluntary and we will indicate whether the information we have requested is required. If you choose not to provide certain information, you may be unable to access and use certain features, obtain certification or recognition that you have completed courses provided via the Opportunity Culture® Portal, or we may be unable to provide certain services to you.

The type of Personal Information you will be asked to provide depends upon the types of our services you use.

We collect several types of information from and about subscribers for our publications and Users of our Opportunity Culture® Portal, including information:

  • By which you may be personally identified, such as name, postal address, e-mail address, telephone number, job occupation title, educational degrees and certification, job history, professional awards and accomplishments, salary information;
  • That is about you but does not individually identify you, such as educational curriculum plans for schools, teacher or student performance statistics; and/or
  • About your internet connection, the equipment you use to access our Opportunity Culture® Portal, and usage details.

We also may collect sensitive personal data such as gender, race/ethnic origin, or information related to medical or other information regarding disabilities or other conditions requiring assessment accommodations. Sensitive personal data will not be collected unless it is for a legitimate purpose and unless you have given express and unambiguous consent.

We collect this information:

  • Directly from you when you provide it to us;
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses; and
  • From third parties, for example, your school system or school administrator, employer, employees, colleagues or a contractor.

The Personal Information we collect on or through our Websites and Portal may include information that you provide by filling in forms on our Websites or Portal. This includes information provided at the time of subscribing to our publications, registering to use our Portal, subscribing to our other services, posting material, or requesting further services. We may also ask you for Personal Information when you enter a submit your information for certification, and when you report a problem with our Websites or Opportunity Culture® Portal.

We process your Personal Information with your consent, where such consent is required by applicable law and you agreed to the use at the time it was collected (or if we subsequently obtain your consent). You may withdraw your consent for us to send you marketing communications at any time by using the link found at the bottom of every email. We also process your Personal Information where this is necessary for the performance of a contract with you or where it is necessary for our legitimate interests of operating, protecting and improving our Opportunity Culture® Portal.

In some instances, Users of our Opportunity Culture® Portal may submit Personal Information about teachers or students to participate in Public Impact®/Opportunity Culture® programs (e.g. registration for programs or certification activities). In such cases, we may not have a direct relationship with the individuals (e.g. other administrators, teachers, or students) whose Personal Information may be processed in connection with participation in the programs. The Users who submit Personal Information are responsible for determining that such sharing or transfer of Personal Information to us is done in accordance with applicable local law and without violating any privacy or data protection rights of any individuals, including, without limitation, providing appropriate notice to the individuals and obtaining any required consents. We acknowledge that Personal Information and information provided to it by Users for programs may be protected under local applicable laws.

If you are a User of our Opportunity Culture® Portal, you confirm that you have authority to consent and/or provide Personal Information on behalf of your school or school system’s administrators, teachers and/or students’ parents (as the case may be) to us via the Opportunity Culture® Portal. If you submit personal data of anyone other than yourself to the Opportunity Culture® Portal, you represent and warrant to us, by using the Opportunity Culture® Portal to submit such data, that you have authority to do so and have done so in accordance with all data protection and privacy laws applicable to you and without violating the individual’s privacy or data protection rights. This includes any requirements to notify individuals about the purposes, uses, transfers and sharing of their Personal Information by us as described in this Privacy Policy and to obtain consent from the person (and/or their legal guardian). In addition, when using certain aspects of the Opportunity Culture® Portal, you may be required separately to affirmatively confirm your authority to us.

Information Posted by Users

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Opportunity Culture® Portal or transmitted to other Users of the Opportunity Culture® Portal or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Additionally, we cannot control the actions of other users of the Opportunity Culture® Portal with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Representations for Data Reported via the Opportunity Culture® Portal

Each User of our Opportunity Culture® Portal agrees to provide accurate, complete and up-to-date Personal Information. Each User is solely responsible for the Personal Information provided. Each User agrees that he or she conforms to all local data protection laws where required by applicable law.

How Information Collected Is Used

Public Impact®/Opportunity Culture® use information that we collect about you or that you provide to us, including any Personal Information, for the following purposes:

  • To present our material, the Opportunity Culture® Portal and its contents to you;
  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide information;
  • To provide you with notices about your account or subscription, including expiration and renewal notices;
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection
  • To register you for our examinations and assessments;
  • To deliver our courses in on-line format;
  • To upload coursework to the Opportunity Culture® Portal;
  • To deliver certificates of completion;
  • To transfer data about participation in our programs to school or school system administrators or others, such as the completion of certificates of completion, the attainment of certification, validation or other status;
  • To conduct internal reporting or research related to Opportunity Culture® program outcomes;
  • To conduct surveys and other activities designed to provide feedback to us about the effectiveness of our programs, materials and facilities;
  • To provide information that promotes and markets Public Impact®/Opportunity Culture® services or other information that we believe would be of interest to you, so long as you have opted in to receive promotional and marketing messages or unless you expressly opt out of receiving such messages or otherwise have withdrawn your consent, as required by law;
  • To identify you when you apply for a password, access password-protected websites or areas of a website, post information to a website or when you send information to the Opportunity Culture® Portal in any form;
  • To create your account, password and profile for a service; and
  • To investigate misuse of our Websites or the Opportunity Culture® Portal, if suspected and enforce claims in connection therewith.

Disclosure of Your Information

Public Impact®/Opportunity Culture® may disclose aggregated information about our visitors, Users, and information that does not identify any individual, without restriction. Public Impact®/Opportunity Culture® may disclose personal information that we collect, or you provide as described in this privacy policy to:

  • Our subsidiaries and affiliates, and
  • Contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

We also may disclose your Personal Information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Use, Opportunity Culture® Portal Terms of Use, and other agreements, including for billing and collection purposes.

If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Public Impact® and Opportunity Culture®, other Users, our customers, or others.

Changes to Privacy Policy

It is our policy to post any changes we make to our Terms of Use, including our Privacy Policy. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on our Websites. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for periodically reviewing the notices posted on our Websites and reviewing our Privacy Policy to check for any changes.
